1. Overview

Please note that each time after entering this website you continue to use it, you will be deemed to have accepted and agreed to be bound by these terms and conditions. If you do not agree to this condition of use, please leave the website immediately. As these terms and conditions may be amended from time to time, those that are applicable at the time of your entering the website will apply to you - so please ensure that you review them each time that you enter this website, as your use of this website signifies your acceptance of the then applicable terms. Regrettably, because of legalities, Nashua Electronics cannot do business on this site with customers living outside the borders of the Republic of South Africa and no attempted transaction concluded by such customer will be valid and enforceable.

2. Shopping environment Security
Nashua Electronics is backed by M-Web's Safeshop Secure Payment gateway and therefore makes use of Secure Socket Layer (SSL) encryption technology to protect your personal information or credit card detail as it travels over the Internet. However, there is no 100% secure transmission of data on the Internet given the current state of Internet technology. We therefore cannot guarantee the absolute security of any information you transmit to us or which we transmit to you.

3. Site Security
You warrant and agree that your login name (Email address) and password shall be used for personal use only and shall not be disclosed to any third party. You will take the necessary precautions to prevent these from being unlawfully used and in the event of a transaction concluded through unlawful means without Nashua Electronics having knowledge of the unlawfulness, you will be bound by such transaction. You agree that Nashua Electronics may take the necessary reasonable steps to ensure the integrity of the Nashua Electronics site and back-office applications. Credit Card transactions are Secure Socket Layer encrypted. Any person who attempts to gain unauthorised access to any page on this website or delivers or attempts to deliver damaging code to this website shall be prosecuted and civil damages shall be claimed in the event that Nashua Electronics suffers any damage or loss.

4. Agreement of Sale
You will be deemed to have made an offer to purchase a product from Nashua Electronics after a product is placed in the shopping basket, the shopping cycle is completed and authorization for payment is received by Nashua Electronics. An agreement of sale between Nashua Electronics and you will only be constituted after the offer to purchase is accepted by Nashua Electronics. Nashua Electronics will be deemed to have accepted an offer to purchase, in which event an agreement of sale will be deemed to have been concluded, when an invoice recording the sale is issued by Nashua Electronics after the completion of the purchase cycle, the order appears on this website and is sent to your e-mail address as specified in your registration detail on the Nashua Electronics website, and payment is received by Nashua Electronics. If the invoice is issued for a part of the offer only, then an agreement will be deemed to have been constituted for such part of the order only, and any overpayment will be refunded. Despite the conclusion of an agreement of sale, Nashua Electronics will be entitled to cancel such agreement in the event that there is not sufficient stock to comply with the terms of the agreement of sale, if the product is withdrawn from the market, in the event that a bona fide error has occurred with the price at which the item was advertised, or in the event that Nashua Electronics reasonably suspects that the transaction is fraudulent. In the event of the cancellation of the agreement of sale or in the event that the full offer is not accepted, Nashua Electronics will forthwith refund any overpayment made in these circumstances.

5. Delivery and Stock Availability
Orders will be delivered by courier to the physical address as specified in the offer as quickly as possible and Nashua Electronics will use its best endeavours to ensure that you receive your ordered goods within seven to fourteen working days of placing the order. Should there be a serious delay in delivery or an out of stock situation we shall contact you immediately via the details provided on the order. Although the costs of delivery are included in the product price (unless specifically stated otherwise), you will be liable for and will pay on demand all reasonable re-delivery costs (including storage and insurance) or if you fail to receive the products. All delivery times that may be quoted or agreed to, will be estimates only. Nashua Electronics will use its best endeavours to adhere to such delivery times but will not be liable in whatever respect in event of a failure to do so. The risk of any goods to be delivered or deemed to have been delivered to you will pass to you on delivery, or on the date that the you fail to take delivery as provided for above. Notwithstanding the delivery of any goods to you, ownership therein shall not pass to you unless and until Nashua Electronics has received payment of the full purchase price thereof.

6. Prices & Payment
All prices quoted include VAT at a rate of 14% and are valid only within the Republic of South Africa. All prices are quoted in South African Rands (ZAR). The price of each product is displayed with the product. The purchase price is strictly net and not subject to any discount. At present, payment can only be made to Nashua Electronics online by means of credit cards. In submitting your order and credit card details you warrant that the user thereof is authorised to make payment with the credit card and that there are sufficient funds available to pay for the order. At the time of placing the order, the transaction details are submitted to the bank and an authorization is obtained for the amount of the order and payment is only collected once an agreement of sale has been concluded.

7. Returns & Cancellations
Every reasonable effort is made to ensure that the items that reach you are the items that you have ordered and are in no way faulty or damaged. Nashua Electronics shall be exempted from and shall not be liable under any circumstances for any damages or claim for any alleged shortage in delivery or damage to the goods in transit, unless notice of such damage or shortage is given in writing to Nashua Electronics within 7 (seven) days of receipt of the goods and the relevant waybills/delivery notes/consignment notes have been endorsed accordingly by the consignee, or in the event of non-delivery (in the case of total loss) such non delivery is notified to Nashua Electronics within 10 (ten) days of the date of dispatch as stated in Nashua Electronics’ advice note or invoice. Should you receive an incorrect, faulty or damaged item you must notify Nashua Electronics by using “Contact Us” on this site or by sending an e-mail to info@nashuaelectronics.com or by phoning 0861 289 665, giving full detail of the transaction and your complaint. The Cardholder shall be liable for all transactions effected through use of the Card. A handling fee of 10% including VAT will be levied on all transactions which are cancelled by the Cardholder/ purchaser.

8. Electronic Discount Vouchers
Nashua Electronics may from time to time issue electronic discount vouchers. Electronic discount vouchers are not exchangeable for cash and are not transferable or assignable. Electronic discount vouchers must be redeemed at www.NashuaElectronics.com towards the purchase of products listed in the online catalogue and cannot be redeemed at any affiliate shops or websites. Electronic discount vouchers may be used in conjunction with on-line promotional offers and special offers. Electronic discount vouchers are limited to 1 (one) per transaction and cannot be used towards orders already placed with Nashua Electronics. Electronic discount vouchers are issued at Nashua Electronics’ discretion and customers do not have a right to discount vouchers nor can discount vouchers be earned. An electronic discount voucher can only be redeemed during its validity period and expiry dates cannot be extended.

10. Warranties
Nashua Electronics warrants to you, subject to the terms hereafter set out, that the product hereby purchased will for a period of twelve months from the date of purchase be free from defects or failures caused by any faulty component used or workmanship applied during the manufacturing thereof.
Warranty Terms
10.1. Application
The product sold to you in terms of the agreement of sale, is subject to this warranty, the terms and conditions of which will be binding on both you and Nashua Electronics as an integral part of such agreement.
10.2. Repair/replacement undertaking
In the event of any fault covered by this warranty manifesting itself during the warranty period, Nashua Electronics will either itself or through one of its authorised Service Centres and or Suppliers, repair the defect and/or replace the faulty part at no charge or, at the option of Nashua Electronics, replace the product if it is, in Nashua Electronics sole discretion, not capable of being economically repaired. “Service Centre” will in this warranty mean either Nashua Electronics or any duly authorised Service Centre of Nashua Electronics. Maintenance services are, however, not covered under this guarantee.
10.3. Territory
This warranty applies to products purchased through this website in the Republic of South Africa, (the “Territory”). After the replacement or repair of a product in terms of this warranty, the warranty will apply only for the remainder of the original period, and will not be extended beyond such original warranty period.
10.4. Claims procedure
Any claim or repair/replacement made by virtue of this warranty will only be accepted if the faulty product is delivered to a Service Centre and is accompanied at the time of delivery with a valid purchase receipt in respect of such product. If you intend to deliver the faulty product to a Service Centre otherwise than by hand, you are to make prior arrangements with the Service Centre and delivery of the product shall be accompanied by the valid purchase receipt, together with, if so required by the Service Centre, a detailed explanation of the technical problem. The Service Centre shall after completion of its attendance in terms hereof, return the product at your risk and expense.
10.5. Ownership of replaced product/parts
Any defective product which has, or parts of such defective product which have been replaced, shall become the property of Nashua Electronics.
10.6. Not Transferable
This warranty is only afforded to the original purchaser of the product and you will not be entitled to cede or transfer, without the prior written consent of Nashua Electronics, any of the rights arising from this warranty.
10.7. No Fault found & Extras
In the event that a claim is made in terms of this warranty and no fault or defect is found in the product, or if the defect is not covered by this warranty, then the Service Centre will be entitled to charge for any labour and parts expended in attending to such claim or the attempted repair of such defect at the then prevailing rates charged by the Service Centre to all its customers for inspections, repairs and replacements.
10.8. Delays
Although a Service Centre will use its best endeavours to effect the repairs without delay, it shall not be responsible for any delay in the event that any parts necessary for the repair of the defective product are not in stock, in which event the Service Centre will use its best endeavours to source such part without an unreasonable delay.
10.9. Abnormal use or vis major
This warranty shall neither apply to malfunction or damage resulting from or contributed to by accidents which occur during transit and/or handling; nor to such malfunction or damage due to incorrect voltages or faults in the house wiring, product misuse, improper use, abuse, neglect or negligence by you or anybody else and/or to use inconsistent with the technical and/or safety standards in the Territory and/or to use of the product outside the Territory and/or to use not solely for domestic and normal purposes and/or to any use of the product other than that described in the operating manual; neither to such malfunction or damage due to abnormal voltage, fire, unforeseen accidents, wear and tear, and/or earthquake, flood, lightning or any other natural disaster, war or any other disturbance (revolution, riot, etc.), or any other external factor beyond Nashua Electronics’ control or the control of any Service Centre. This warranty will further not apply and be deemed to have terminated if any person (including you) other than Nashua Electronics or its Service Centres has effected of attempted to effect any repairs, adjustments, rebuilding, dismantling, modifications, changes or conversions and in respect of any product on which the serial number has been changed, tampered with or removed.
10.10. Warranty applies only to product itself
This warranty is limited to the fixed components of the product only and does not extend to any operator replaceable consumables or materials of whatsoever nature, or the loss thereof as a result of any defect or fault covered by this warranty and will not apply to styli, bulbs, AC adaptors, batteries, dust covers, dust bags, belts, brushes, video tapes or any other accessories, cabinet parts, epoxy coatings, glass/ceramic turntable platters, or any other parts of a natural life that is less than the expected natural life of the product.
10.11. No warranties
Neither Nashua Electronics nor any Service Centre, dealer, distributor or agent, will be bound by any warranty, implied, express or otherwise, that is not contained herein, including (but not limiting the generality thereof) any common law warranty, or warranty as to the fitness of any product for a particular purpose.
10.12. Representations
No person or entity has authority to vary the terms and conditions of this warranty. Nashua Electronics may, however, run promotions from time to time in which extended warranty terms may be made applicable, and in such event a formal written special warranty certificate will be issued which will, together with the unaltered portions of this warranty, apply as the warranty in respect of such product.
10.13. Limitation
This warranty will constitute the only warranty, guarantee or undertaking with regard to condition of, defects in or the suitability for use of the product and excludes any other express or implied or common law warranty, not contained herein. The right to claim the repair or replacement of any part will constitute your sole remedy against Nashua Electronics and all other remedies, including but not limited to the right to claim damages (of whatsoever nature and whether consequential or not) are excluded and waived and will not be available to you.

11. Exclusions & Limitation of Rights
You will not have any claim whatsoever against Nashua Electronics for any failure to carry out any of its obligations or transactions as a result of vis major, force majeure or any other act or occurrence beyond its control, including but without being limited to any strike, lock-out, shortage of labour or materials, delays in transport, accidents of any kind, any default or delay by any sub-contractor or supplier, riot, political or civil disturbances, the elements, any act of any State or Government, any delay in securing any permit, consent or approval required by Nashua Electronics for supply of the goods under contract, or any authority, or any other cause whatsoever beyond the control of Nashua Electronics. You will not have the right to cancel any order on the basis that the goods are not suitable for the purposes for which they are required, whether those purposes are known by Nashua Electronics or not. If any goods or any part thereof are to be supplied in accordance with any specifications, measurements or other instructions furnished by you, you will not have any claim of any nature whatsoever against Nashua Electronics as a result of any error, discrepancy or defect in those specifications, measurements or other instructions. All specifications, illustrations, drawings, price lists, dimensions, performance figures, advertisements, brochures and other technical data furnished by Nashua Electronics in respect of the goods, and whether in writing or not, are furnished only on the basis that they will not form part of any contract, or be relied upon by you for any purpose. Nashua Electronics shall under no circumstances whatsoever be liable for any loss of profit or any damages, direct or indirect, consequential or otherwise, sustained by you and arising from any transaction or purported transaction between the parties.

12. Disclaimer
Neither Nashua Electronics nor any of its distributors, sub-contractors, partners or affiliates shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this website or the services or content provided from and through this website. Nashua Electronics makes no representations or warranties that, amongst others, the content and technology available from this website are free from errors or omissions or that the service will be completely uninterrupted and error free. The Nashua Electronics.co.za website is supplied on an “as is” basis and has not been compiled or supplied to meet your individual needs or requirements. It is your responsibility to satisfy yourself prior to entering into this agreement with Nashua Electronics that the service available on this website will meet your requirements and be compatible with your hardware and software. Neither Nashua Electronics nor any of its partners/affiliates shall be liable to for any damage, loss or liability whatsoever nature arising from the use or inability to use any product sold on this website.

14. Governing Law
The Nashua Electronics website is hosted, managed and operated within the Republic of South Africa and is therefore governed by South African law.
These terms are subject to the provisions of the Electronic Communications and transactions Act no. 25 of 2002 (the Act”) and any of the terms that are in conflict with any of the compulsory provisions of the Act will be deemed to have been modified so as to comply with such provisions of the Act.

By entering into any Nashua Electronics competition, entrants agree to the rules set out below.
Competitions are not open to the following people:
a. The directors, members, partners, agents, advertisers, employees or consultants of Nashua Electronics, or any associated partner of the company
b. The spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in a) above; and
c. Anyone outside South Africa (unless otherwise stated)
By entering the prize draw, you are deemed to have read and accepted these terms and conditions. All entry instructions form part of these terms and conditions.
The winner will be responsible for any additional costs incurred in taking advantage of their prize.
Prizes are not transferable and cannot be deferred or exchanged for cash.
Prizes will only be issued after the close of the competition.
Winners may be required to appear in the magazine and website, or on television or radio, for which no fee will be payable.
TV licenses will be required for certain prizes.
Entrants enter into the competition, and use prizes won, at their own risk. Nashua Electronics and / or any of its partners / advertisers cannot be held responsible for any accident, injury, harm or loss as a result of entry into the competition or use of a prize.

Nashua Electronics and its associate media partner reserve the right to cancel the competition without notice at any time, if deemed necessary in their opinion, or if circumstances arise outside of their control. The judges' decision is final and no correspondence will be entered into.
